The Tarrant County Felony Alcohol Intervention Program (FAIP) is a post adjudication program for high-risk repeat DWI offenders. If you have been charged with a felony DWI and have multiple intoxication offenses in your past, you may qualify for the Felony Alcohol Intervention Program. The goals of this program are to:
- Increase successful treatment outcomes for those who are most likely to jeopardize the safety of the community
- Reduce the costs of repeated crime
- Address DWI as a substance abuse problem thereby increasing public safety
- Change the attitudes and behavior of DWI offenders
Eligibility for Felony Alcohol Intervention Program:
- Charged with DWI (felony repetition)
- At least 17 years old
- Currently resides in Tarrant County
- No prior 3G convictions, or pending 3G cases
- No prior convictions for intoxicated assault/manslaughter or involuntary manslaughter
- United States citizen or a lawful permanent resident
- Not on parole or probation
- Accepted by the FAIP team
Process for Acceptance into FAIP:
- District Attorney files felony DWI case
- Initial Screening within 30 days – FAIP coordinator conducts initial screening
- Legal Screening – District Attorney determines legal eligibility
- Letter to Defense Attorney – FAIP coordinator notifies defense attorneys of DWI defendants who have met initial criteria
- Pre-Sentence Investigation
- Team Decision – FAIP team votes on admission
- Plea of Guilty to felony DWI case
- Judge Catalano (CDC3) supervises the defendant during the program
- Clinical Assessment
Program Structure:
- Program cost of $1,350.00
- Four year probation sentence (7 year TDC sentence if revoked)
- Hard DL suspension for 6 months – 1 year
- 10 days of custody
- Partner in Recovery (PIR)
- 160 hours of community service during probation term
- Intensive Supervision
- Substance Abuse Assessment (and follow on treatment requirements)
- Ignition Interlock device
- Recommended classes
- Weekly court compliance hearings
Benefits of FAIP: A defendant that successfully completes the FAIP program will gain the life skills necessary to equip them to win their battle against alcoholism. They will pay less in probation fees than they would with a long-term probation and avoid a lengthy prison sentence.
